US SAYS POPE IMMUNE FROM MOLESTATION LAWSUIT

The U.S. Justice Department has told a Texas court that a lawsuit accusing Pope Benedict XVI of conspiring to cover up the sexual molestation of three boys by a seminarian should be dismissed because the pontiff enjoys immunity as head of state of the Holy See.

The former Cardinal Joseph Ratzinger was named as a defendant in a civil lawsuit by three plaintiffs who allege that Patino-Arango, a seminarian on assignment at St. Francis de Sales church in Houston, molested them during counseling sessions in the church in the mid-1990s. Patino-Arango has been indicted in a criminal case by a grand jury in Harris County, Texas, and is a fugitive from justice.

The lawsuit alleges Ratzinger, who headed the Vatican's Congregation for the Doctrine of the Faith before becoming pope, was involved in a conspiracy to hide Patino-Arango's crimes and help him escape prosecution.

The lawsuit cites a letter from Ratzinger written in Latin to bishops around the world, explaining that "grave" crimes such as the sexual abuse of minors would be handled by his congregation and that the proceedings of special church tribunals handling the cases were subject to "pontifical secret."

Officials at the U.S. Embassy to the Holy See said they were familiar with the case but had no other immediate comment. The Vatican said it had no comment.

The pastor of a Roman Catholic parish who was placed on administrative leave last year was arrested Wednesday on misdemeanor sex abuse and forcible-touching charges, prosecutors said.

The Rev. Gerald S. Twomey, of Our Lady of Fatima Church in Manorhaven, pleaded not guilty at his arraignment in First District Court in Central Islip and was released on his own recognizance.

Twomey, 53, was suspended as pastor of the Manorhaven parish last June amid allegations he had abused a 10-year-old boy more than a decade earlier. Since being placed on administrative leave, Twomey "has not presented himself as a priest in public" and his been in a "supervised setting," Diocese of Rockville Centre spokesman Sean Dolan said.

An organisation representing some of the victims of paedophile priests has written to the Irish Conference of Catholic Bishops asking for a meeting with Pope Benedict XVI during a visit expected to take place next year.The bishops were to receive the warning during a special session held today to discuss matters including ongoing paedophile scandals.

Sean O'Conaill, the coordinator of Voice of the Faithful in Ireland, which includes Catholic priests as well as abuse victims, said that if the bishops refused to arrange a meeting between the victims and the Pope there would be "outrage and disgust". "In that situation we would be forced to consider dignified protests during the papal visit. A boycott by contrast would be silent and unheard. There would be serious consideration given to protests," he said.

O'Conaill said: "It is unthinkable that Pope Benedict XVI could visit Ireland in the near future without alluding to [the] betrayal of children. Were he to leave Ireland without meeting, in dialogue, a representative gathering of survivors, this could only be regarded as a papal endorsement of that betrayal and as final proof that our church leaders pay only lip service to the principle of the equal dignity of all members of the church. "

Such a visit would therefore signal not a revival of the Irish church but the final triumph of denial and evasion, and the end of any prospect of a 'New Evangelisation' in Ireland in its aftermath."
